**MESSAGING SERVICE PRIVACY POLICY**

Overview

Sapphire Aesthetics and Wellness L.L.C (“Sapphire,” “we,” “us”, or “our”) is committed to protecting your privacy. This SMS Messaging Privacy Policy (“Policy”) notice provides more specific information on how the third-party text messaging service operating on behalf of Sapphire (the “Messaging Service”) collects and processes your personal information.

By using the Messaging Service, you agree to the terms of this Policy. Sapphire reserves the right, in our sole discretion, to modify or change this Policy at any time with or without prior notice to you. The date of the last update will be posted at the top of this Policy for your convenience. This Policy, and any changes, are effective as soon as posted and supersede any prior Policies. Your continued use of the Messaging Service following the posting of any changes to the Policy constitutes your full acceptance of those changes.

How We Collect Information

We collect personal information in the following circumstances:

  • Direct Collection, when you provide information by responding to text messages.
  • Automated Processes, when you subscribe to the Messaging Service.

What Type of Information We Collect

Direct Collection

Through your use of the Messaging Service, we will receive Personal Information through our third-party service provider. “Personal Information” is information that individually identifies you. We directly collect the following personal information:

  • Mobile phone number
  • Any user name that you select in connection with the Messaging Service
  • Opt-out preferences
  • Content of your text message responses to us.

Automated Collection

Our messaging service automatically collects the following information. This information does not include PII.

  • Device status indicating whether a device is available for messaging
  • Carrier (e.g. Verizon, AT&T, etc.)
  • Country associated with the phone (we are not sending international text messages)
  • Delivery status
  • Error codes indicating why a message was not delivered (e.g. number associated with a landline, unreachable device, etc.)

How This Information Is Used

We use the personal information we collect to communicate with you regarding Sapphire Appointments, Services, Giveaways, and Promotions. We may also use Personal Information to enhance the Messaging Service features and customize and personalize your experiences on the Messaging Service.

With Whom This Information Is Shared

Sapphire will not disclose, rent, or sell your personal information to third parties for marketing or promotional purposes.

What Choices You Can Make About Your Information

If you wish to unsubscribe from text messages for a campaign, you can reply with words, ‘STOP’ and you will no longer receive messages.

How Information Is Secured

Sapphire recognizes the importance of maintaining the security of the information it collects and maintains, and we endeavor to protect information from unauthorized access and damage. Sapphire strives to ensure reasonable security measures are in place, including physical, administrative, and technical safeguards to protect your personal information. In using the Messaging Service, your information will travel through third-party infrastructures which are not under our control (such as a third-party provider’s SMS delivery platform or your carrier network). While Sapphire strives to protect your information against unauthorized use or disclosure, we cannot ensure or warrant the security of any information you provide. By using the Messaging Service, you agree that Sapphire is not liable for any unintentional disclosure.

Children and Intended Audience

The Messaging Service is not intended for children under 13, and Sapphire does not knowingly collect information from children under the age of 13.

Children aged 13 or older should not submit any Personal Information without the permission of their parents or guardians. By using the Messaging Service, you are representing that you are at least 18, or that you are at least 13 years old and have your parents’ permission to use the service.

**Cancellation policy**

Your appointment time is reserved just for you. A late cancellation or missed visit leaves a hole in the therapists’ day that could have been filled by another patient. As such, we require 24 hours notice for any cancellations or changes to your appointment. Patients who provide less than 24 hours notice, or miss their appointment, will be charged a cancellation fee to the card on file.
